The Rajhistan Conversion Bill

I just came across this report from The Hindu which talks about the freedom to convert to any religion. -> http://www.hindu.com/2011/04/21/stories/...331100.htm

So my question: As it is reported, the Governor of Province refused to sign the bill passed by the provincial assembly, and even when it was forwarded to the President, the President himself refused to sign it either. The bill though in the end got through anyway. But is not the signing of legislation binding on the state Governor and the President once it is passed by the State assembly? And if it, when the Governor and President had refused to sign it, did the BJP go to SC to contest it?
